General terms of service

This website (the “Site”) is owned and operated by LogPoint A/S (“LogPoint”, “we”, “our” and “us”), and is subject to the following terms and conditions (the “Terms”). By accessing or using this Site, our products or services, you acknowledge that you have read, understood and agreed to be bound by these Terms and to comply with all applicable laws and regulation. If you do not agree to these Terms, please refrain from using this Site, our products or our services.

These Terms were last updates on 26 June 2018. We may change these Terms from time to time. You are expected to check this page from time to time to take notice of any changes that we have made. Some of the provisions contained in these Terms may also be superseded by provisions or notices published elsewhere on our Site.

If you personally, or you on behalf of a company or organization, you represent, has obtained a license to use our products or services, the “End User License Agreement” will apply in addition to these “Logpoint General Terms of Service”.

We aim to update or Site regularly and may change the content at any time. If the need arises, we may suspend access to our Site, or close it indefinitely. Any of the material on our Site may be out of date at any given time, and we are under no obligation to update such material.

Access to our Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Site without notice (see below). From time to time, we may restrict access to some parts of our Site, or our entire Site, to users who have registered with us.

We will not be liable if for any reason our Site is unavailable at any time or for any period.

Notwithstanding the above, LogPoint grants you a limited, personal, nontransferable, non-sub-licensable, revocable license to access and use the Site and Materials only in the manner presented by LogPoint and as expressly permitted by LogPoint. Any other use of the Materials for any other purpose is a violation of these Terms and LogPoint’s or its licensors’ copyright and other intellectual property rights. Your failure to comply with any of these Terms will result in automatic termination of any rights granted to you, without prior notice, and you must immediately destroy all copies of downloaded materials in your possession, custody or control.

“LogPoint” is a registered trademark. All trademarks, service marks, and trade names appearing in the Site are the property of LogPoint or the respective owners of such marks or names, and are protected by applicable copyright and trademark laws. You agree not to defame or disparage LogPoint and its trademarks, service marks, and trade names, or any other aspect of the Site or the Materials. Any use of any of the trademarks, service marks, or trade names appearing throughout the Site without the express written consent of LogPoint or the owner of the mark or name, as applicable, is strictly prohibited. Any rights not expressly granted in these Terms are reserved.

From time to time, this website may contain technical inaccuracies or other content errors, and we do not warrant the accuracy of any posted information. To mitigate the risk of error, you should use only the most up-to-date web pages, and confirm the accuracy and completeness of information before using it to make decisions relating to services, products, or other matters described in this Site. We are not responsible for the accuracy of content on any areas of the website where users may post or transmit information. You are prohibited from posting any libelous, obscene, defamatory, pornographic or other content that would violate any laws.

If any term in these Terms is found by competent judicial authority to be unenforceable in any respect, the validity of the remainder of these Terms will be unaffected, provided that such unenforceability does not materially affect the parties’ rights under these Terms.

By accessing and using our Site you agree to use our Site only for the purposes intended as permitted by these (a) Terms, and (b) applicable laws, regulations and generally accepted online practices or guidelines.

You agree to indemnify and hold harmless LogPoint, its suppliers and licensors, their respective officers, directors, employees, agents, and affiliates, and each of them from any third-party claim, liability, loss, damage, cost, or expense (including without limitation reasonable attorneys’ fees) arising out of or related to your use of the Site or any Materials it contains; your failure to comply with these Terms; your infringement, violation, or misappropriation of any third party rights or any applicable law or regulation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND THE MATERIALS IT CONTAINS ARE PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND. In the event of any dispute or disagreement arising under or in connection with these Terms (including a dispute or disagreement as to the validity of the Terms), such dispute or disagreement will be referred to and resolved under the exclusive jurisdiction of the Danish courts.
